What documents does each spouse get in a joint Estate Plan?

There are many documents in an Estate Plan, and the list differs slightly for joint Estate Plans. In such cases, if it’s a Trust-based Estate Plan, you will receive one (1) Living Trust, one (1) Certificate of Trust and one (1) Confirmation of Names and Fiduciaries.

However, each person will receive his/her own:

•Pour-Over Will (or regular Wills and no Trust, if it’s a Will-based plan)
•Durable Power of Attorney
•Advance Health Care Directive
•HIPAA Authorization
•Memorial Instructions
